As speculation surrounding the outcome of the lawsuit continues to mount, attorney Fred Rispoli has stepped forward to offer a potential end date for the legal battle. Utilizing crucial statistics related to Judge Torres’ summary judgment ruling pattern, Rispoli arrived at his estimated date.
In a recent tweet, attorney Rispoli highlighted an interesting disparity in Judge Torres’ Motion for Summary Judgment (MSJ) grant rates for defendants and plaintiffs. He noted that the judge’s MSJ grant rate for defendants currently stands at 37%, while the rate for plaintiffs is 24%.
Further analysis conducted by the pro-XRP lawyer revealed that the median duration for Judge Torres’ MSJ decision, from the initial filing to the final order, is approximately 249 days. It’s important to mention that both the SEC and Ripple filed their respective motions for summary judgment on September 17, 2022.
Interestingly, Rispoli also discovered that a significant majority of Judge Torres’ summary judgment decisions fall within the range of 146 to 330 days, accounting for around 60% of her rulings. Consequently, considering the filing date of September 17, 2022, a potential ruling may have been expected on May 21, 2023. However, attorney Rispoli promptly ruled out this date, acknowledging that it has already passed and we find ourselves well into July.
